Subject: Final Selection List of the candidates for the post of Works Supervisor, Public Works (R&B) Department, advertised vide Notification No. 05 of 2020 dated 24.12.2020, under Item No. 134.
NOTIFICATION
Whereas, the Public Works (R&B) Department, vide Indent No. PW(R&B) NG/124/2019 dated 30.09.2020, followed by Indent No. PW(R&B) NG/124/2019 dated 17.12.2020, forwarded the requisition for making direct recruitment to the following 76 posts of Work Supervisor.
Whereas, the J&K Services Selection Board (JKSSB), advertised these 76 posts of Works Supervisor, vide Notification No.05 of 2020 dated 24.12.2020, under Item No. 134, for seeking applications from the eligible candidates; and
Whereas, in terms of the notified selection criteria, the selection for these posts of Work Supervisor was required to be made on the basis of Written Examination and, accordingly, the JKSSB, conducted Computer Based Test for selection of candidates to the aforementioned posts w.e.f. 08.11.2021 to 12.11.2021 and on the basis of performance of the candidates in the aforesaid Computer Based Test, the result/score sheet of the candidates was published vide Notification No. SSB/CoE/CBT/2022/390-396 dated 15.01.2022; and
Whereas, after the publication of Result/Score Sheet, the candidates falling under the consideration zone were called for Document Verification (DV) vide No.SSB/COE/CBT/2022/857-66 dated 02.02.2022 & Supplementary Document Verification No. SSB/COE/CBT/2022/3950-55 dated 19.04.2022; and
Whereas, the Selection Committee, constituted vide Order No.221-SSB of 2022 dated 01.07.2022, prepared the Provisional List for these posts in accordance with merit obtained by candidates and having regard to the rules governing the posts; and
Whereas, in its interim Order dated 13.04.2022, in WP (C) No. 271/2022 titled "Parvaiz Ahmad Rather & Others Vs Union Territory of J&K & Others", the Hon'ble High Court, JKL has directed as under:
"In view of the aforesaid facts and circumstances, in the ends of Justice, the interim order dated 22.02.2022 is modified and it is provided that as the selection process for all 490 posts has been concluded, the respondents may proceed to declare the result also but keeping five posts vacant/reserved of the Works Supervisor for the petitioners till the decision of the writ petition."
Whereas, the Provisional Selection List for the aforementioned posts was notified vide No. SSB/Secy/Sel/WS-2023/299-304 dated 23.02.2022, and the candidates were advised to represent with grievances, if any. Five posts, among the advertised posts, were required to be kept reserved as per the relevant category petitioners i.e. two in Open Merit at Sr. No. 35 and 36, two in RBA at Sr. No. 07 and one in OSC at Sr. No. 02; and
Whereas, one of the required eligibility conditions for these posts of Works Supervisor, Public Works (R&B) Department is III Certificate in Building Construction or Carpentry Trade. Amongst the candidates figuring in the Selection, some candidates have acquired/obtained required Certificate Course in Building Construction/Carpentry from various Private Institutions located at different places in and outside J&K; and
Whereas, in response to the Provisional List notified for these posts, the Board received various representations, which have been examined for necessary action under rules by the re-constituted Selection Committee which was constituted vide Office Order No. 101-SSB of 2023 dated 18.05.2023. Majority of the representations pertained to the candidates who have obtained their Certificates in the relevant trade from Royal Polytechnic College, Srinagar; and
Whereas, the Board, accordingly, took up the matter with the Board of Technical Education with regard to the validity of the trade certificate in respect of the candidates who have obtained it from Royal Polytechnic College, Srinagar, which vide its letter No. BOTE/ITI/Veri/2023/2444 dated 01.08.2023, has conveyed as under:
"... that the said college was not registered by the erstwhile Technical Education Department, presently Skill Development nor J&K BOTE to conduct the examination of the ITI Courses. The JKBOTE is verifying only those certificates of the candidates who have appeared in the examination conducted by the JKBOTE, all the Certificates issued by the Royal Polytechnic College, Srinagar, have been issued at their own level. With regard the Certificates issued in favour of the candidates listed in the communication are not genuine, as these candidates have not appeared in the examinations conducted by the JKBOTE."
Whereas, all such and similarly situated candidates, who were figuring in the Provisional Selection List, have not been considered for Final Selection on account of the above and ITI certificate in Building construction or Carpentry Trade; being one of the requisite qualification for these posts, and
Whereas, in terms of the extant rules/guidelines, among these, three posts have been earmarked to the Persons with Disabilities (PWDs) under Horizontal Reservation, while no ESM candidate was available in the consideration zone; and
Whereas, after factoring in all the above aspects, the Final Selection List for the above mentioned 76 posts of Works Supervisor, as prepared by the concerned Selection Committee, was placed before the Board in its 241 meeting held on 16.10.2023, which, after due deliberations, approved its notification. Now therefore, after taking into consideration all the aforementioned factors and having regard to the merit secured by the candidates and the rules governing the subject, the Final Selection List of the candidates for the post of Works Supervisor, Public Works (R&B) Department, advertised vide Notification No. 05 of 2020 dated 24.12.2020, under Item No. 134, is hereby notified as per Annexure-A to this notification. Out of the advertised posts, five (05) vacancies have been kept unfilled/reserved in compliance to the interim directions of the Hon'ble High Court, JKL, Srinagar, in WP (C) No. 271/2022 titled "Parvaiz Ahmad Rather & Others Vs Union Territory of J&K & Others.
It is further notified that:
(1) The above Final Selection List shall be subject to outcome of WP (C) No. 271/2022 titled "Parvaiz Ahmad Rather & Others Vs Union Territory & Others", and other writ petition(s)/application(s), if any, pending adjudication before any competent court of law.
(1) The List shall also be subject to the outcome of such enquiry, involving any candidate(s), as figuring in this List.
(ii) Formal recommendations to the concerned indenting departments shall be forwarded separately.
(iv) The candidates, whose recommendations are kept withheld shall furnish the requisite documents within a period of one month from the date of this Notification.
